yes, but since he would be ding dong dead he'd have a hard time proving he didn't intend to use that weapon against me. And I forgot to make the distinction that he clearly pulled his weapon first, before you pulled yours.

"The dead talk" The whole CSI thing is real. When it comes to firearms use, police agencies that I know go to extra measures to prove a case. A case I was told about went as far as proving that the intruder did not have his finger on the trigger.
When you pull out you weapon you better be ready, willing, and able to shoot. Conversely, you better also be ready NOT to shoot. This is a lot of "what ifs" and will be decided in court. The idea is to live with your decision. If you make the wrong one by the standards of the courts, can YOU still live with your decision?
For me, if your in my home with a gun, you meant to do me harm. YOUR DEAD!!!

Phortis Nespin had one of the best reply's here. There are a whole lot a variables to be decided on in court. However it will start with the decisions you make in your home. If it were me. "No' I would not shoot in most cases. I have always said, "A dead man don't talk". Also I feel there is a difference between self-defense and killing in defense. Whether you kill someone trying to harm you or not, you still end up taking a life.

This has gotten some good debate, and I hope it keeps going on. I ask this for the reson of how people would feel about taking a life if they had to. Jedi always try to use peace but as you see here some times that can not always be. This is always a touchy this to talk about and it upsets most people that do not like firearms. As I said I work in law enforcement and have many firearms and I will use them on the job or at home.

I don’t know about the legality of shooting someone. I do not specialize in law or even understand many of them. I do know that before one acts they should be able to accept the consequences of their actions. Not that all consequences are proportionate to the action; but, there are always consequences.
Do I think it is wrong or right to soot an intruder? Depends! And I can’t guess what my actions will be until I am faced with that particular situation. I have many weapons of all types and I am proficient with all of them. But I can tell you that when I do hear something that needs investigating my firearms are not the first thing I grab.
It may sound a bit arrogant, but I believe that in my home I am on more than equal grounds with an armed assailant even if I am “only” carrying a melee weapon. Besides, the walls of my home will stop none of the rounds fired by any of the firearms I own.
I will most likely be subject to some legal retaliation for taking of a man’s hand or splitting him open. But he will live and I will have acted in a manner that I can live with.
