Probably because we only enforce the ToS on a case by case basis, using a common sense approach. It's more about following the spirit of it rather than the letter of it

As I say, (and mark my words), all that can come of this is most of the forum turning into an extended sermons and journals section from whence any kind of clash is directed out into the "shark tank" while this new "shark tank" subforum devolves into a place considered to be a dump and where people increasingly quit caring to not behave as if that is exactly where they are.
What you suggest will - if my intuition is to be relied upon - destroy almost everything worthwhile about TOTJO. The only way one can have your shark tank and keep the Temple as it is, is by having this shark tank be an unofficial place somewhere else so that none can be directed there with reference to the official rules.

We can, and we do. However, there is no separation between one and the other. There is no place one needs to go to either get one aspect of it or to avoid the other. You cannot just make a place for the open, honest, and hot-headed without simultaneously implying that the rest of the forums is "not for them".
